1. Who you are contracting with
The FixPix service ("FixPix", "we", "us") is operated by Richard Struck. By creating an account or using FixPix, you ("you", "user") agree to these Terms & Conditions.
2. Acceptance
By accessing or continuing to use FixPix, you agree to be bound by these terms. If you do not agree, you must stop using the service. You confirm you are of legal age and, where you act for an organisation, you have authority to bind it.
3. The service
FixPix is an AI-assisted photo restoration and colourization tool. You upload photos and optional notes (such as desired eye colour) and we return a restored version. The service is provided on an "as is" basis with no guarantee of uninterrupted or error-free performance.
4. Acceptable use
You must not misuse the service. In particular you must not:
- Use it for any unlawful, fraudulent, or harmful purpose.
- Upload content you do not have the rights to use, or content depicting other people without appropriate permission.
- Generate deepfakes, sexually explicit imagery involving real people, harassing imagery, or content that infringes intellectual property or privacy.
- Interfere with the security of the service, including probing, scanning, scraping, distributing malware, or attempting to bypass technical limits.
- Reverse engineer, resell, or redistribute the service.
You are responsible for the photos you upload, the notes you provide, and how you use the restored outputs. We may remove content, refuse outputs, or suspend accounts that violate these rules.
5. Intellectual property
We retain all rights in the FixPix software, models, branding, and documentation. You retain rights in the photos you upload. You grant us a limited licence to host and process your content solely to provide the service. Restored outputs are yours to use; you remain responsible for ensuring you have rights to the underlying inputs. Rights-holders who believe content infringes their rights may contact us for takedown; repeat infringers will have their accounts terminated.
6. Accuracy of AI outputs
Restored and colourized images are produced by AI and may contain inaccuracies, invented detail, or artefacts. They are not suitable for forensic, medical, legal, or other regulated use without independent human review.
7. Payments and credits
FixPix uses a one-time credit-pack model — there is no subscription. Payments are processed by our payment partner, who acts as Merchant of Record for transactions and handles payment processing, tax calculation and remittance, billing inquiries, and chargebacks on our behalf. Refund mechanics are governed by our Refund Policy. For all order and refund support, email rich@fixpix.au.
8. Accounts
You must provide accurate information, keep it up to date, and keep your credentials confidential. You are responsible for activity under your account.
9. Suspension and termination
We may suspend or terminate your access if you materially breach these terms, fail to pay, present a security or fraud risk, or repeatedly or seriously violate our policies. You may stop using the service at any time. On termination, your right to use the service ends; we may delete content after a reasonable period.
10. Warranties and liability
To the fullest extent permitted by law, we disclaim all implied warranties including merchantability and fitness for a particular purpose. Our aggregate liability for any claim relating to the service is limited to the fees you paid for the service in the 12 months preceding the claim. We are not liable for indirect, consequential, or special damages including loss of profits, data, or goodwill. Nothing in these terms excludes liability that cannot be excluded by law.
11. Indemnity
You will indemnify us against claims arising from your content, your unlawful use of the service, or your breach of these terms.
12. Changes
We may update these terms from time to time. Material changes will be communicated through the service. Continued use after changes means you accept the updated terms.
13. Governing law
These terms are governed by the laws applicable at Richard Struck's place of business, without regard to conflict-of-laws principles. Disputes will be heard in the competent courts of that jurisdiction.
